Additionally, TotalEnergies' 10GW project in Germany is also being reassessed. As early as last June, TotalEnergies' withdrawal plan had already begun to emerge. In the press release regarding the granting of the concession in the N-9.4 block, TotalEnergies mentioned that the delay in grid construction prompted the company to review the concessions it had obtained since 2023 and look forward to conducting negotiations and dialogues with the German government.

According to an internal discussion document obtained by NDR (North Rhine-Westphalia Broadcasting) and Süddeutsche Zeitung, some projects in the auction rounds from 2023 to 2025 may not be feasible. TotalEnergies is seeking to reclaim these blocks and hopes to recover 750 million euros in guarantees. However, a recent written response provided by TotalEnergies indicates that developing nearly 10 GW of offshore wind power projects in Germany remains a priority, and this matter involves a response plan for the delays that have occurred.

The exit mechanism proposed by BWO allows developers to voluntarily return the project area within four weeks after the regulations come into effect. The returned area will then be redistributed starting from 2027 according to the revised offshore wind power auction framework of Germany. This redistribution may be carried out through a special bidding process.

BWO believes that the German government failed to include a buyback option for the winning projects in the offshore wind power auction rules. However, the current auction mechanism in Germany poses significant risks for enterprises, and these risks are almost impossible for enterprises to control - especially when there is a severe delay in grid connection. As a result, up to 16 GW of offshore wind power capacity cannot be put into operation, and the stagnation of these projects will also threaten the entire offshore wind power supply chain in Germany.

BWO拟议的提案还规定，退还中标地块的开发商不得再次竞标同一区域，而且有义务向主管部门移交开发商已取得的项目数据和初步的研究报告等资料。

The proposed regulations by BWO stipulate that the developers who have received the winning bids for the land parcels are not allowed to bid for the same area again, and they are obligated to hand over the project data and preliminary research reports that the developers have obtained to the relevant authorities.

BWO的方案还提出，开发商已经支付过的环境和渔业相关拍卖款项将不予退还，但保证金将全额退还，以鼓励开发商尽早披露不可行的项目。

The BWO plan also states that the funds already paid by the developers for environmental and fishery-related auctions will not be refunded, but the deposit will be fully returned to encourage developers to disclose unfeasible projects as soon as possible.

A month ago, BWO also called on the German government to make more explicit commitments and formulate a binding roadmap to ensure the development of the offshore wind energy industry.
